These Terms of Use apply when you access or use the WishDeck website, web app, and related services. If you do not agree to these Terms, do not use WishDeck.
Eligibility and Accounts
You must be able to form a binding agreement to use WishDeck. If you are under the age of majority where you live, use WishDeck only with the involvement of a parent or legal guardian.
If you create an account, you must provide accurate information, keep your credentials secure, and are responsible for activity under your account.
Use of Our Service
You agree to use WishDeck only for lawful purposes. You must not:
- Use WishDeck in any way that violates applicable laws or the rights of others.
- Attempt to gain unauthorized access to any account, system, server, or network.
- Interfere with the service, bypass security measures, or introduce malware or other harmful code.
- Upload or share content that is unlawful, infringing, deceptive, abusive, or otherwise harmful.
We may restrict, suspend, or terminate access if you violate these Terms or create risk for the service or other users.
User Content and Public Sharing
You retain ownership of content you submit to WishDeck, such as wishlists, notes, links, and uploaded images.
By submitting content, you grant WishDeck a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify as needed for formatting, display, and distribute that content solely to operate, improve, and promote the service.
You are responsible for the content you upload or share and you represent that you have the rights needed to do so. If you make a wishlist, profile, or other content public or share a link, that content may be viewed by others.
WishDeck Intellectual Property
All content and software that WishDeck creates or provides, including our branding, text, graphics, logos, designs, and code, is owned by WishDeck Software Inc. or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our original content without prior written permission.
Third-Party Retailers and Affiliate Links
WishDeck may link to third-party retailers, products, websites, or services. Some of those links may be affiliate links, which means we may earn a commission if you make a purchase through them.
WishDeck is not the seller or merchant of third-party products. Pricing, availability, shipping, returns, refunds, warranties, and any purchase-related issues are handled by the applicable third party, not by WishDeck.
Service Availability and Termination
We may change, suspend, or discontinue any part of WishDeck at any time. We may also remove content or disable accounts when reasonably necessary for legal, security, operational, or policy reasons.
Disclaimer of Warranties
WishDeck is provided "as is" and "as available." We do not guarantee that the service will always be available, secure, accurate, or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, WishDeck Software Inc. will not be liable for any indirect, incidental, special, consequential, punitive, or similar damages arising out of or related to your use of WishDeck.
Privacy
Your use of WishDeck is also subject to our Privacy Policy.
Modifications
We may update these Terms of Use from time to time. When we do, we will update the date above. By continuing to use WishDeck after the updated Terms become effective, you agree to the revised Terms.
Governing Law
These Terms of Use shall be governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
